1. Appointments and Orders
1.1 All consultations and fittings are by private appointment only at our studio in Chester. Alternatively, we can travel to you depending on where you are located or arrange a mutual meeting point.
1.2 We do not hold a stock of wedding dresses, other than a collection of sample gowns. This means that any dress ordered from us will be created to your own specifications or selected from our collection and made to order in a fabric and colours of your choice. You will be required to sign the ‘Measurements Form’ and ‘Quotation Form’ confirming that the measurements taken on the ‘Measurement Appointment’ are correct. The description and price of the dress will be shown on your quotation form as signed by you at the time you place your order (‘Order Date’).
1.3 Our minimum ordering time for wedding dresses is 16 weeks before your wedding, however, this may change depending on the time of year.
1.4 When ordering from our existing design collection you will need to contact us and request a measurement form. You can choose from a selection of fabrics we will suggest, or discuss alternative options.
1.5 The price does not include any alterations deemed to be excessive due to weight lost or gained. The price also does not include any alterations to the original design specification that will require additional work or costs, for example, change in design, fabric or embellishment once the process has begun. For such changes, we will provide a revised quote and revised timeline.
1.6 Please be advised that Atelier 5 will not accept any requests to copy another designer’s creations.
2. Payment terms
2.1 The quoted price will be held for 28 days. Atelier 5 reserves the right to change this quotation after 28 days if an order has not been confirmed.
2.2 On the order date you agree to pay a deposit amounting to 50% of the total price of the garment to contribute towards the creation of any pattern, toile and materials.
2.3 Once the deposit has been paid, the work on the dress or toile will start. The price quoted will be fixed for the duration of the order or for a period of 12 months, whichever comes first.
2.4 All outstanding amounts will be due on completion of the order and must be paid in full before collection/delivery. Payments must be received within 7days of final invoicing, prior to, or upon collection.
2.5 Payments can be made by cash/cheque, Paypal or Bank transfer.
2.6 If the final payment is made by cheque we reserve the right to delay collection/delivery until the cheque has cleared.
3. Cancellations and Refunds
3.1 If an order is cancelled within 7 days of the Order Date, a refund of part or all of the deposit will be made. Any money from the deposit already spent by Atelier 5 towards the order (e.g. purchasing of fabrics and materials) will not be refunded.
3.2 If an order is cancelled after 7 days of the Order Date, the deposit is non-refundable.
3.3 For orders cancelled after 7 days of the Order Date, the following balance will be due depending on when the order is cancelled:
3.3.1 After completion of the toile, before starting the final wedding dress: 25% of the balance will be due.
3.3.2 After the final wedding dress has been started: the whole of the remaining balance will be due.
3.4 Any materials purchased, and assembled items such as constructed samples, toile and dress remain the property of Atelier 5 in the event of a cancellation.
4.1 Once the dress/garment is ready, it can be either collected in person or delivered to an address provided by you. Ownership of the dress/garment will pass to you when delivery is made and you will, as from the date of delivery, become responsible for all risk of loss or damage to the dress/garment.
4.2 Shipping and insurance is not included in the price if not requested at the time of ordering.
4.3 Shipping costs are non-refundable.
4.4 All dresses are sent using Royal Mail Recorded Delivery or International Signed For, or an equivalent tracked courier and tracking details can be provided. All dresses and garments are carefully wrapped in tissue paper and packed in boxes for their journey.
5.1 We do not accept any returns or exchanges on any Couture/Bespoke/Made to Measure garments
5.2 However, you can return or exchange garments which are Ready to Wear, made in a standard UK size purchased from our website and a full refund will be credited to you upon receipt of the item, unworn and in its original conditions.
5.3 The sender is responsible for postage costs.
6. Website and Information
6.1 We reserve the right to make changes to Atelier 5’s website and its contents without prior notice.
6.2 Atelier 5 strives for accuracy in all item descriptions, pictures and availability, links, pricing and any other item-related information contained in or referenced on our website. In the event of an error in an item’s description, pictures, availability or delivery options, pricing etc. due to typographical error, human error, incorrect or updated information Atelier 5 reserves the right to refuse or cancel any orders placed for these items and immediately correct and/ or remove the information.
6.3 Orders placed for items with incorrect or inaccurate information may not be honoured and may be refused or cancelled regardless of confirmation. If a deposit has been made, the customer shall be credited for the full amount of the charge. Should this happen for an ordered item, the customer will be notified immediately and the customer always has the option to reorder the item at the corrected price or with corrected information.
7. Remote Orders
7.1 Atelier 5 offers an online consultation service at its discretion and upon request. Styles that require careful professional fitting may not be suitable for this service. Atelier 5 will provide guidance on this during the initial consultation. Online consultation can be done via email or other virtual methods to discuss your ideas, gather all your requirements, and obtain a photo of yourself in order to make recommendations. An estimated cost will be generated for your consideration.
7.2 Once this is confirmed and the deposit made we will email initial design sketches, the measurements form and order form to you.
7.3 Where possible, the fabric, trim and any embellishment samples will be posted for you to see in person. Alternatively, Atelier 5 may supply a suitable photograph where samples are not available.
7.4 When the design and fabrics are agreed and confirmed and we have your filled measurements form, order form and deposit, Atelier 5 will start the work on your item and keep you informed about the progress.
7.5 Once complete your order will be shipped to you at least 2 weeks prior to your event.
7.6 Atelier 5 cannot accept responsibility for inaccurate measuring taken by a client remotely.
8. Wash and Care
8.1 Please take care of your new handmade garments by handling properly. Unless stated otherwise, your garment will be dry-cleanable only and can be pressed with a cool iron with no steam. Atelier 5 recommends that you use a protective cloth to prevent iron marks on your garment. Please read the guidelines according to your selected fabrics.
8.2 For silk garments and wedding dresses, Atelier 5 brings to your attention the fact that silk is a natural fibre and therefore there may be natural variations on the fabric. Atelier 5 does not guarantee that such minor fabric faults will not appear on the garments although every care is taken to prevent this. Atelier 5 shall not be liable for any claim arising from any dissimilarity or disparity in shade or tone of the different fabrics.
9.1 Atelier 5 shall not be deemed to be in breach of an order contract as a result of acts beyond the reasonable control of Atelier 5 including without limitation act of war, riot, civil commotion or terrorist attack, malicious damage, compliance with any law or governmental order, accident, fire, flood or storm.
9.2 Atelier 5 brings to your attention the fact that a handmade couture garment, especially in silk fabrics, is a particularly delicate item and extreme care should be afforded to it. Consequently, Atelier 5 shall not be liable for any damage to the garment arising from fair wear and tear, willful damage, accident, negligence by you or any third party or use otherwise than as recommended by Atelier 5 or failure to follow Atelier 5’s instructions or any alteration or repair carried out without Atelier 5’s approval.
9.3 Atelier 5’s liability for all direct or indirect losses as a consequence of any breach by Atelier 5 of this contract shall be limited to the price of the garment.
9.4 These Terms and Conditions of Sale do not affect your statutory rights as a consumer.
